The Proceeds of Crime Act 2002 has caused grave concern to professional advisers in the UK. Family lawyers in particular are troubled by the onerous obligations that the Act imposes upon them and their clients. Yet the provisions, even after the landmark decision in P v P, are open to several interpretations. Furthermore, many argue that the duties created by the Act are incompatible with the concept of legal professional privilege and the Human Rights Act 1998.
