
Students commonly experience difficulties with the law of trusts because it seems to be further removed from the everyday world than other subjects. The terminology is confusing, the concepts are abstract, and certain types of transaction are complex and obscure. Textbook on Trusts istherefore designed to alleviate students' difficulties by stating the law as clearly as possible, without sacrificing clarity of exposition in the more complex areas. The authors concentrate on the principles of the subject and confine detailed coverage to those areas which are commonly covered intrusts courses at degree level. The main changes in this fifth edition have taken place within the chapter on History and Outline of Equitable Jurisdiction, and on Remedies. Consideration has also been given to contracts and trusts in light of the enactment of the Contracts (Rights of Third Parties)Act 1999. Additions have been made to the chapters on trusteeship to accommodate the new Trustee Delegation Act 1999 and the Law Commission's proposals concerning the powers and duties of trustees. Coverage has also been expanded to include pension funds, as a reflection of their growing importancein the context of trusts.
