Excerpt:...that undertaken up to the present time have not accomplished the object desired, for such reason, considering that an enterprise of such vital importance ought not to be abandoned, however difficult may be the means which should be taken in order to accomplish its end; therefore, Be it enacted by the Legislative Assembly of the Territory of New Mexico: Section 1. That it is made the duty of the probate judge of the county of Santa Fé, as soon as it shall be practicable, to appoint a commission of three persons of learning and science from the residents within precincts numbers three, four, and five, and said commission once appointed, shall be required to proceed in the discharge of the duties which shall be set forth in this act Sec. 2. In pursuance of the previous section it shall be the duties of the commission appointed to proceed to make a careful examination of the bed of the Santa Fé river as far as its source, and shall select a proper and convenient place for the construction of a dam, which should be constructed in a firm and solid manner that may serve to dam up the water for the purpose of having a reservoir of the same, so that it may be used in time of drouth or whenever it may be deemed most necessary. It is understood that said commission shall make an estimate as exact as possible, which in their sound judgment they shall believe necessary of the cost to be incurred in the construction of said dam. And when the commission referred to may have discharged the duties which are hereby designated, they will report to the probate judge, who will as soon as he receives it, proceed as hereinafter set forth.
