This longstanding casebook addresses the law governing the federal courts and their relationship to the state courts. The early chapters focus on issues relating to separation of powers, especially issues of jurisdiction and justiciability. Subsequent chapters consider the law that federal courts should apply, including federal common law, implied rights of action, and constitutional remedies. The book then addresses a number of topics that relate to federalism, including abstention, Section 1983 litigation, state sovereign immunity, and habeas corpus. The chapters are sufficiently self-contained that instructors can decide for themselves which ones to focus on and the order in which they are taught.
