Excerpt:... Commonwealth Vs. J. Langdon & Co., Incorporated. Aet of June 30, 1885--Corporations--Deduction of state tax on payment of interest on indebtedness--Tax on indebtedness of predecessors in title. The three mill tax imposed by the Act of June 30, 1885, P. L. 193, did not apply to any portion of the calendar year 1885, for which year a four mill tax had been assessed and collected under prior laws, before the date of the passage of said act. No obligation to assess or collect a tax is imposed on corporations by the fourth section of the Act of June 30, 1«85, except upon the payment of interest, and when no interest has accrued or been paid within any calendar year, or within that portion of it covered by the Auditor General's settlement, no tax can be recovered by the Commonwealth. When a corporation purchases real estate bound by the lien of mortgages or other evidences of indebtedness executed by its predecessors in title, and to protect its Interest in the property pays the interest due thereon, it is not required to deduct from the interest so paid any tax 00 such mortgages or other evidences of indebtedness, and is not liable to the Commonwealth for failure to do so.
