
After a lot of research and being in the construction field for about 28 years, including hands-on experience in the execution of contracts, I thought to pen down this book titled “The law of construction contracts in the Sultanate of Oman and the MENA region”. The book contains the principles and laws picked up from the civil codes of Oman, UAE, Qatar, and Egypt. While the articles of the Oman civil code are provided in the main text, the reader can refer to the footnotes to see the article numbers of the other countries. The book also contains relevant judgments and discussions on various principles like time at large, time is of the essence, time bars, and other relevant issues and how they apply in the MENA region, especially in Oman, UAE, Qatar, and Egypt. There has been a lot of uncertainty about the laws applicable to construction contracts in the MENA region. Whatever research is available currently is available in the Arabic language. Common law lawyers and contract managers are sometimes unaware of the principles and the laws which apply to different issues which frequently arise in construction contracts. There was a vacuum in this area, and this book intends to fill this gap by providing a detailed explanation with references to the codified laws of four major countries of the MENA region, namely Oman, UAE, Qatar, and Egypt, explaining these with references to some of the critical Supreme Court judgments. The book looks into these issues critically and lays out the differences from Common law. The book is a must-have for professionals working in these regions.
