He did not negotiate the contracts with claimant, and it is not shown that he had any authority to make changes therein or vary the terms thereof on behalf of the Government. 12. Clarleton Richmond, as a lieutenant in the Equipment Division, Ordnance Department, when contract E. T. 329 was negotiated, and as a captain in the Procurement Division, Ordnance Department, when contract E. T. 417 was negotiated, was the negotiating officer on behalf of the Government with respect to those contracts. 13. Claimant states that the changes were made under article 9 of the contract, and, further, "it was as much our obligation to make required changes as to make goods; and as much the obligation of the Government to pay for the changes as to pay for the goods." In order to assure a clear understanding of the issue thus raised, article 9 of contract E. T. 417 is quoted in full as follows: "It is stipulated and agreed that the contracting officer may make changes in the specifications forming part of this contract; and if such changes involve extra labor and material, a fair addition to the price will be made therefor; but if such changes involve less labor and material, a fair deduction will be made from the contract price. No claim for addition or deduction on account of such changes will be made unless the same have been ordered in writing. Any delays in manufacture attributable to changes in the work so ordered shall be duly kept account of by the contracting parties and a corresponding allowance of time made in estimating reductions of price for delays in delivery.
